Terms and Conditions

 

DEFINITIONS

In these conditions the following expressions have the following meanings:

“Sumei Studios” – Sumei Studios Ltd. whose registered office is at 60 Frederick Street, Birmingham, B1 3HS.

“The Client” - any person or firm or company dealing with Sumei Studios or any servant or employee of such a person firm or company.

“Equipment” - all studio fixtures and other equipment provided by Sumei Studios.

“Studio” - the premises of Sumei Studios for the time being where the services and equipment are provided.

“Booking” – the agreed time the Client has chosen to use Sumei Studios.

 

The terms and conditions as highlighted below are automatically agreed once a booking has been made between The Client and Sumei Studios.

 

SECTION 1 – BOOKING CONFIRMATION

A booking is considered confirmed after Sumei Studios receives cleared payment.

 

SECTION 2 – BOOKING TIME

The booking time commences and concludes as per the confirmed hire time. If the client is late, the booking will still end at the confirmed hire time, otherwise charges will occur.

Late exit from the studio space will incur a fee of £45.

 

SECTION 3 - SETUP AND TAKEDOWN TIME

The client must plan for setup and takedown time with the confirmed hire time to avoid a late exit fee of £45.

 

SECTION 4 – LEAVING THE STUDIO IN A REASONABLE STATE

The studio and any shared facilities used must be left in a reasonable state at the end of the clients booking. This must be the same way the studio and the shared faiwas found at the commencement of the clients booking.

Sumei Studios reserves the right to charge a cleaning fee of £45 for any additional cleaning required to restore the studio to its original state, other than the standard cleaning provided from regular wear and tear.

 

SECTION 5 – PUBLIC LIABILITY

It is the responsibility of the client to ensure that they have public liability insurance for all persons in the studio during the hours of use, to cover any accident damage, injury or death.

The client who booked the studio is responsible for any allergies and complications that can arise from perishable and consumable items brought onto the studio premises.

 

SECTION 6 – USE OF EQUIPTMENT

Studio hire comes with a range of lighting and equipment options as standard. All equipment used must be returned promptly at the end of the hire period in the original condition and the client is liable for repair or replacement costs that occur from damaged or missing equipment, as highlighted in section 7.

The client may not without the written consent of Sumei Studios; remove equipment from the studio premises; modify or alter or tamper with equipment in anyway; use equipment in a manner not recommended by the manufacturer.

 

SECTION 7 – BREAKAGES, LOSSES AND DAMAGES

The client is responsible for any breakages, losses or damages caused to the studio, equipment or shared facilities by the client, or any other person(s), during the allotted booking time.

The studio and all the equipment used is at the risk of the client and Sumei Studios shall not be liable for any loss or damage to materials, props or equipment. This includes consequential loss of profit however caused, arising out of the use of, or the inability to use the studio or the equipment supplied or agreed to be supplied (all equipment is subject to availability).

The client is fully liable for repair or replacement costs cause by any breakages, losses or damages that occur during the period in which they temporarily occupy the studio.

No alterations or additions to the studio space or equipment is permitted without prior written consent.

Sumei Studios reserves the right to charge clients the cost of rectifying any breakages, losses or damages caused by the client or any other person(s) during the allotted booking time. The client must report any breakages, losses and damages to a member of Sumei Studios staff before departing the studio. We reserve the right to make a charge to the clients credit / debit card to cover the cost of repair or replacement of said breakages, losses or damages.

The client must notify staff at the time of supply if the condition of the equipment is not acceptable, and shall pay any costs incurred by Sumei Studios arising out of any breach of the prior conditions.

Sumei Studios shall not be liable to the client for any loss, damage, expense or for any consequential loss (including loss of profit) arising out of or in connection with; any damage to loss of property by the client or any third party; any breakdown, stoppage or failure of the facilities / equipment provided by Sumei Studios.

Sumei Studios is not liable for any unforeseen circumstances that may change the suitability of the studio for the purpose of your booking. Sumei Studios is not liable for any disturbances caused by the building in which it is located.

The client will temporarily be provided with a key to Sumei Studios during the duration of the booking, to allow the client to exit and easily re-access the studio if required. If the key to Sumei Studios is not left in the studio after the clients booking has concluded, then there will be a key replacement fee of £30.

Backdrops with excess dirt or wear are charged at £10 per meter, per backdrop.

 

SECTION 8 – BOOKING CHANGES AND CANCELLATIONS

The studio booking may be changed as per the request of the client, dependent on the notice time provided, and subject to availability:

· A booking change or cancellation request made with a notice of 168 hours (7 days) or more, may be rescheduled without charge or fully refunded if preferred.

· A booking change or cancellation request made with a notice of less than 168 hours (7 days), but more than 72 hours (3 days), may be rescheduled without charge, or cancelled with a cancellation fee of 100% of the original booking fee.

· A booking change or cancellation request made with a notice of less than 72 hours (3 days), but more than 24 hours (1 day), may be rescheduled with a rebooking fee of 50% of the original booking fee, or cancelled with a cancellation fee of 100% of the original booking fee.

· A booking change or cancellation request made with a notice of less than 24 hours will not be accepted or refunded.

Sumei Studios reserves the right to request a new agreed time with the client if the studio services cannot be fulfilled adequately. In this instance, if there is no suitable new agreed time for the client, then a refund of 100% will be offered.

Sumei Studios reserves the right to cancel a studio booking without refund for any reasons highlighted in section 9 or 10.

If the booking has previously been rescheduled and the original booking date has passed, then the booking cannot be cancelled. Sumei Studios may offer store credit at their discretion.

 

SECTION 9 - TERMINATION

Sumei Studios may terminate any booking or hire contract if the client is found to be in breach of any terms and conditions.

If a client is found to be aggressive, malicious or disrespectful to a member of Sumei Studio staff, then the staff member reserves the right to terminate any booking immediately and ban the client from any future bookings.

 

SECTION 10 - NOISE

Noise levels must be kept to a reasonable level during studio hire bookings. Clients are asked to consider other occupants and neighbouring residents when using the studio.

If you do not respect the noise rules then your booking may be cancelled without a refund.

 

SECTION 11 - VARIATIONS

These terms and conditions are valid at time of booking and are subject to variation. Clients will be notified of any variations prior to booking.

 

SECTION 12 – APPLICABLE LAW

All agreements shall be governed by the laws of the United Kingdom
